The eyes of the oil and gas industry are on Mozambique. Initial exploratory drilling in 2007 revealed an economy changing volumes of natural gas offshore and since then the promise of vast natural riches has grown steadily to the point that Mozambique could soon be the world’s fourth largest natural gas exporter on the planet. Mozambique is shaping up to become the world’s next great energy superpower.

Mozambique’s remarkable reserves of natural gas, which are estimated to hold over 100 trillion cubic feet (expected to double following the prospecting phase), places the country as one of the largest proven natural gas reserve holders worldwide, considered the major industrial project in Africa. Few industries have high demanding needs for specialized equipment as the oil and gas industry, whether it is drilling, refining or petrochemical sectors.

Today’s excitement and vast prospects stand in stark contrast to the situation just over a decade ago when Mozambique possessed no tangible hydrocarbon resources to speak of. This situation began to change however once Mozambique issued an offshore exploration licence to American-based operator Anadarko in 2007. Dubbed the Area 1 block, within the Rovuma Basin, the exploratory drilling proved fruitful revealing 480ft of natural gas in February of 2010.

This initial discovery was soon followed by others. The Lagosta Prospect and Windjammer Prospects were the next to follow and were of sufficient quantity to make Anadarko and Italian-energy company Eni pull the trigger on further exploration and development work.With further drilling it rapidly became clear that the waters of Mozambique – and especially the Rovuma Basin – contained truly vast reserves of high-quality natural gas.

Currently, the natural gas production is concentrated in onshore fields of Pande/Temane in the country’s center-southern region, being operated by Sasol, which exports natural gas via a pipeline, after processing the gas in a central processing facility. 

More recently, all attention turned to the north of the Country, Cabo Delgado province – more specifically Areas 1 and 4, which are both offshore, where multinational oil and gas companies have been investing in prospection and, soon hereafter, construction of platforms and drilling for natural gas.

The Total Project in Area 1 – which was recently acquired from US Anadarko – and has the participation of Mitsui, ONGC, Bharat PetroResources, PTTEP, Oil India Limited and ENH, is expected to increase investments in the country by a few more billion US dollars, along with additional infrastructure development opportunities. 

Several Billions USD are being invested in the Coral South FLNG Project, led by Italian multinational ENI (with participating interests by Exxon Mobil, CNODC, ENH, Kogas and Galp Energia) in the Area 4 of the Rovuma Basin, which is expected to come into production in 2024, with roughly 30 years of extraction.

Mozambique Rovuma Venture, also known as MRV,  announced October 2019, its initial investment decision on the Rovuma LNG Project, which includes the construction of two natural gas liquefaction plants with the capacity to produce 15.2 million tonnes of LNG per year. MRV is an incorporated joint venture owned by Eni, Exxon Mobil and CNPC, which own a 70% stake interest in the Area 4 Exploration and Production Concession Contract (“EPCC”), while Galp, Kogas and ENH each hold a 10% interest.

Upstream

With the Rovuma basin offering such huge natural gas reserves, Mozambique is expected to experience intense upstream production activity over the coming decade. One of the most notable upstream projects is the Offshore Area 4 Coral Field Upstream Development which will develop the block’s estimated 7 to 10 Tcf of gas. The development plan will involve the use of a FLNG vessel to exploit the gas reserves at the block, as well as extensive subsea infrastructure

Midstream

With so much natural gas soon to be available, it’s no surprise to see Mozambique exploring a plethora of midstream LNG projects. The Mozambique LNG Project is one of the biggest and will involve the construction of an LNG plant fed by the offshore Golfinho field and Mamba-Prosperidade complex. Facilities to be constructed include two trains, each with a capacity of 6 mtpa for a total of 12.8 mtpa, two LNG storage tanks, each with a capacity of 180,000 cubic metres, condensate storage, a multi-berth marine jetty and associated utilities and infrastructure. Start-up of the project is expected to take place in 2024.

Downstream

At present Mozambique’s downstream sector is effectively non-existent. Currently Mozambique does not produce any crude oil or have any refining capacity and relies on imports to satisfy all of its oil product demand. This should change with the construction of Mozambique’s first refinery. Although very much in the feasibility study stage the Mozambique New Refinery will process crude supplies from the Rovuma basin, Mozambique basin, and imported feedstock from the international market. Although details of the refinery are scant at this stage, it is predicted that the refinery could be up and running by 2024.

The next stage will be to improve the transportation and distribution of natural gas (including natural gas storage facilities) as it is at a very early stage, with the transport network consisting of the Mozambique-South Africa pipeline and the recent distribution network (a partnership between State-owned Empresa Nacional de Hidrocarbonetos and Korean Kogas) restricted only to certain districts of the capital city, Maputo. New transport pipelines shall be developed, connecting the gas-rich north and south of Mozambique.

Mozambique is taking proactive efforts to ensure that local people and businesses benefit. A robust set of local content policies have already been implemented. Known as the ‘National Content Strategy’ the policy focuses on three pillars:

  • Operators are encouraged to employ Mozambican citizens with appropriate qualifications at all levels of their organisation (or as sub-contractors).
  • The development and implementation of effective training programmes for Mozambican employees in each phase and level of operations of projects.
  • Operators are encouraged to engage in the preferential purchasing of local goods and services when internationally comparable in terms of quality, availability, quality and price.

Several years have passed since the approval of the legislation that currently regulates the oil and gas sector and since then the Mozambican Government has been focused on improving its capability of providing the necessary assistance to those operating in this sector and carrying out the also important supervision, reviewing the powers granted to the public institutions and approving the template of the Oil Prospection and Exploration Agreement that shall be entered into between the Government and the concessionaires. 

The Constitution of Mozambique provides that all-natural resources, whether located on/in land, underground, inner waters, territorial sea, and the continental platform or in the Mozambican exclusive economic area are the property of the State. The Ministry of Natural Resources is responsible for directing and executing the governmental natural resource policies and for the supervision of the National Petroleum Institute  (“Instituto Nacional de Petróleo” – “INP”), which is  the regulatory authority responsible for the administration and promotion of Petroleum Operations.

Among other state entities that play regulatory and supervisory roles, the State participates through the national oil company “Empresa Nacional de Hidrocarbonetos, E.P.” (“ENH”), and any investor wishing to explore Mozambican oil resources must associate with ENH.  Therefore, ENH participates in all phases, from research to production, refining, transportation, storage and commercialisation of oil and gas and their derivatives, including LNG and GTL, both in and out of the country.

The current available general legal framework is silent in respect of the specific regulation of LNG facilities. Only Mozambique’s Special Regime for Natural Gas Liquefaction Projects in Areas 1 and 4 of the Rovuma Basin (Decree-law 2/2014, December 2) – which applies to concessionaires under existing EPCCs – regulates any special purpose vehicles (“SPVs”) established by such concessionaires and any persons entering into contracts with concessionaires or SPVs (contractors, financiers and employees) as well as their subcontractors, and in connection with activities relating to the development and operation of Offshore Areas 1 or 4 and which are undertaken under existing EPCCs or any other contracts with the Government of Mozambique.

The Petroleum Law Regulation has recently been amended to include changes relating to the Stock Exchange and the public bids to be carried out by the concessionaires. In order for foreign legal entities to be holders of the right to carry out Petroleum Operations, they must be registered in Mozambique and demonstrate that they have the technical capability and adequate financial resources for the effective conduction of Petroleum Operations.

Legislation in Mozambique typically focuses on local content by being prescriptive regarding the procurement of local labour, services and goods. At a base level, local content is to be encouraged by the contractor (and in some cases subcontractor), but no minimum percentage is prescribed. While at the top end, local content is prescribed by law with minimum percentages for goods and services and local employment requirements.

In the context of the acquisition of goods or services by Petroleum Operations right-holders, single or collective foreign entities that provide services related to Petroleum Operations must associate with single or collective Mozambican entities. Procurement has become a target for regulation and this does pose significant problems for multinational companies doing business.
